HB25-1312 enables the state to consider misgendering as coercive control in custody cases and protects gender-transition facilitation from out-of-state legal interference.
Colorado House Democrats passed controversial legislation this week that could allow the state to remove children from parents who do not affirm their gender identity, including in cases of misgendering. The bill, titled House Bill 25-1312, or the “Legal Protections for Transgender Individuals Act,” also formally defines “misgendering” and “deadnaming” as discriminatory acts, further empowering courts to weigh such behavior in child custody proceedings.
The bill explicitly requires courts to treat acts like using a person’s pre-transition name or rejecting a child’s preferred gender identity as forms of “coercive control” during custody evaluations. Under the law, these actions can be used as grounds for removing children from parents deemed non-compliant with the child’s gender identity.
